A Study on the Activation Plan of the Support Systems for SMEs¡¯ Technology Protection

[Abstract]
As technology competition among companies has intensified, the importance of technology protection is increasing day by day. However, according to the status of technology leakage in Korea, the technology protection level of SMEs is weak. SMEs' technology leakage continues to occur, and the damage can be even more serious to SMEs. Thus, the government is operating various support systems for SMEs. However, despite the support system, the interest and use of SMEs is low. This study examines the current status of major support systems for SME technology protection in Korea, and empirically analyzes the recognition and expectation effects of companies on the support systems. Based on the results, this study discusses ways to improve the recognition and use of the support system. The results of this study will contribute to strengthening SMEs 'technology protection by increasing the utility and enhancing the utilization of the support systems.
A Study on Punitive Damages System in Technology Protection Related Laws: Focusing on Patent Act, TSPA, ITPA, FTSA, MBCA

[Abstract]
In Korea, punitive damages were introduced in the 2011 Fair Transactions in Subcontracting Act(FTSA), and in 2019 the Patent Act, Trade Secret Protection Act(TSPA), Industrial Technology Protection Act(ITPA), and Mutually Beneficial Cooperation Act(MBCA). In punitive damages, the judgment of ¡®intentional¡¯ is especially important, and it is necessary to refer to US precedents since there is no accumulated case. Major Company can avoid intentional counseling through the advice of lawyers, but SMEs may have to punish punitive damages due to a lack of awareness of the system. In the case of TSPA, ITPA, FTSA, and MBCA, except for Patent Act, the provisions related to proof of damage have not been well maintained yet. Therefore, the data submission order system of these laws needs to be revised to the level of patent Act need to be. TSPA needs to be amended in the future to estimate the amount of the royalties in estimating the amount of damages so that it can receive the 'reasonably' estimated amount rather than the usual amount. On the other hand, ITPA, FTSA, and MBCA do not have any provisions for the estimation of damages. Besides, it is difficult to evaluate the technology value in the case of leakage or deodorization of new technologies. An Exploratory Research on the Effects for SMEs of the Technology Battle between the United States and China - A Focus on Information Security Issues of Huawei

[Abstract]
The technology conflict between the U.S. and China is deepening recently. The U.S.-China battle began as a national security issue but is comprehending as a U.S.¡¯s check for China¡¯s rapid technological advancement. China is rapidly growing in several indexes including R&D expenditure, patent application, and publications, and is challenging the U.S. in 5G and Artificial Intelligence. In 2018, Huawei became the largest 5G network/equipment provider and second largest smart phone manufacturer in the world. Now, Huawei is outperforming at AI chipset manufacturing, Bigdata analysis and cloud, positioning to become a critical player in the 4th industrial revolution. The purpose of this research is to analyze the effect of recent Huawei issues to Korean SMEs focusing on the relation between Huawei and Korean companies; the cooperation status from the Global Value Chain (GVC) perpsective, and Korean government¡¯s policies related to Huawei¡¯s information security issues will be the three main frames for the analysis. Then, this research proposes policy implications such as increasing Korea¡¯s competitiveness in manufacturing and information security.
Strengthening the Legal Basis for Security Rule to Protect Technology and Trade Secrets for Small Businesses

In Korea, various schemes have been implemented to prevent the outflow of technology, but they do not bring practical effects. In general, we focus on follow-up measures such as strong punishment in case of violation of the law. In terms of proactive prevention, it is not shown to have any real preventive effect, even though it includes such matters as imposing security measures on companies or conducting a survey. this paper examines the need to strengthen the protection of business secrets by reviewing the employment rules between companies and workers presented in the Labor Relations Act and the Labor Standards Act as a realistic alternative. In most companies, even though the employment rule is the highest standard of private regulations, the employment rule has no matters on the prevention and protection of technology leakage. The employment rules require all employees working for companies to agree and notify in the Labor Standards Act, so it is necessary to reflect them as standards in the standard employment rules because it shows that all employees of the company can have a common sense of security and present legal compliance with security-related documents, such as security pledges and security-related guidelines and procedures.
Effects of Conflict Management Strategy Within Supply Chain on Partnership and Performance

While individual enterprises with different objectives each other within supply chains require a variety of resources to achieve their own seeking goals and performances, it is necessary to form interdependent relationships among the enterprises to secure the resources what they need, as the individual enterprises are supposed to have limitations on such as time, space and cost to secure all the resources. In this process, conflict possibilities rise and opportunistic behaviors increase due to those environmental factors such as unbalanced information among enterprises, limited rationality, pursuit of interests, and risk aversion. Those existing studies on conflicts in the field of supply chains have limitations in that they failed to present specific conflict management strategies based on the conflict types from the perspective of the conflict resolution mechanism as the studies have made only focused on investigating the causes of conflicts and the impact of conflicts on performance. In this study, therefore, it used the TKI model of Kilmann and Thomas(1977) to subdivide the conflict management strategies in the process of transactions within supply chains by enterprises, and looked into the impact on partnership and performance according to each strategy. As the results, it showed that those types of conflict management strategies such as concession type and cooperation type had a positive(+) impact on the relationship commitment as a factor of partnership, and it was identified that the relationship commitment had a positive(+) impact on performance. In other words, it can be considered that the enterprises making use of the concession type & the cooperation type conflict management strategies under the situation of conflict would be able to have a very positive impact on their performances if they can make good relationship commitment such as investments in and efforts for the sustainable relationship along with the conflict management, while recognizing the importance of relationship. The most important meaning of this study lies on in terms of that it would be contributable to strengthening the partnership between enterprises and minimizing the risk of supply chains caused by conflicts through these results from the study.
The Effects of the Entrepreneurial Team¡¯s Diversity on Business Performance of New Venture

[Abstract]
Many researchers conducted studies on the relationship between entrepreneur¡¯s characteristic, capability, strategy and performance of new venture. However, the development of scientific technique and the complexity of the business environment have stimulated entrepreneurial teams rather than individuals. Therefore, the necessity of theoretical and practical study on the effect of the characteristics of an entrepreneurial team on the new venture companies was suggested. Initial research on entrepreneurial team diversity has primarily addressed the impact of demographic diversity on performance. In order to verify the research model of this study, 287 delegates of new venture companies that participated in the projects at the 18 Centers for Creative Economy & Innovation in 17 regions of the country conducted validity and reliability test based on the questionnaire to which they answered. The result shows that only gender diversity among demographic diversity affected non-financial performance. Information diversity influenced career diversity on financial performance and diversity in education on non-financial performance. Also, the higher the previous sharing experience, the better the financial performance. Value diversity has negative effect on both financial and non-financial performance. Based on the results, theoretical and practical implications are derived. Also suggested are methodological limitations and future research directions.
The Relationships between Founders¡¯ Entrepreneurial Leadership, Team Learning Behavior, Team Boundary Spanning, and Perceived Performance in the Early-Stage Startups

[Abstract]
This study aimed to examine relationships between founders¡¯ entrepreneurial leadership, team learning behavior, team boundary spanning, and perceived performance in early-stage startups. The following results were recorded: (i) the indirect effects of entrepreneurial leadership on perceived performance via team learning behavior were statistically significant (¥â=.309, p<.05). (ii) relationships between team learning behavior and perceived performance were strengthened by team boundary spanning behavior (¥â=.259, p<.05). In this study, three practical implications are provided as follows: (i) startups need to seek team learning readiness and external learning stimulus to facilitate generative and transformative team learning; (ii) accelerators need to develop an entrepreneurial leadership program for founders; and (iii) startups need to explore external information by interacting with investors, R&D institutions, and other startups to strengthen the impact of team learning behavior on performance. Furthermore, two directions for future research are suggested as follows: (i) future researchers need to test causal relationships between entrepreneurial leadership and team learning behavior based on a newly designed time-series measurement plan; (ii) the actual effects of entrepreneurial leadership, team learning behavior and team boundary spanning on financial performance need to be tested two or three years later when the financial performance of early-stage startups usually becomes evident.
